Terms of Service

1. Acceptance

By accessing or using Tournament Goose ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms constitute a legally binding agreement between you and Tournament Goose.

2. Description of service

Tournament Goose provides software for organizing recreational sports leagues and tournaments, including bracket generation, match scheduling, score tracking, and team management. The Service is provided on an as-is, as-available basis. We reserve the right to modify or discontinue any feature at any time.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

4. Account registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not share your credentials or allow others to access your account. You agree to notify us immediately at [email protected] if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.

5. User content and data

You retain ownership of the content you create through the Service — including leagues, teams, tournaments, and scores. By submitting content, you grant Tournament Goose a worldwide, non-exclusive, royalty-free license to store, process, and display that content solely as necessary to provide the Service. We do not sell your data. We may share data with trusted third-party service providers (such as hosting infrastructure and error monitoring) only to the extent required to operate the Service. 6. Acceptable use

You agree not to use the Service to:

  • Harass, threaten, or harm other users
  • Distribute spam, malware, or unsolicited communications
  • Attempt to gain unauthorized access to any part of the Service
  • Reverse-engineer, decompile, or copy the Service
  • Violate any applicable law or regulation

We reserve the right to suspend or permanently terminate accounts that violate these Terms, without prior notice where warranted.

7. Intellectual property

The Service, including its design, code, and branding, is owned by Tournament Goose and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or proprietary materials without prior written consent.

8. Availability and disclaimers

We aim for high availability but do not guarantee uninterrupted or error-free access. The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We will make reasonable efforts to communicate planned downtime in advance.

9. Limitation of liability

To the maximum extent permitted by applicable law, Tournament Goose and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service. Our total aggregate liability for any claim arising under these Terms shall not exceed the greater of (a) the total amount you have paid us in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations; in such cases, liability is limited to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Tournament Goose and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Dispute resolution

Any dispute arising from these Terms or the Service shall first be submitted to informal negotiation by contacting us at [email protected]. If not resolved within 30 days, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. To the extent arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

13. Changes to these terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice in the app at least 14 days before the changes take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms.

14. Termination

You may delete your account at any time. We may suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.
